High lights of Party Constitution (Amended to comply with interim constitution of 2063 B.S)
| Preamble |
Nepalese nationals, with unprecedented unit, embarked again on the road to restore democracy in 1990 when 1950 revolution, 1959 general election and 1980 referendum could not attain the national dream of transforming the feudal and orthodox setup to a democratic welfare state and rule of law. Green Nepal Party has come into existence with a mission to uphold martyrs' dream, democratic fighters' aspirations and people's will.
Green Nepal Party is committed to protect and preserve Nepalese nationalism, sovereignty of people, multiparty system, human rights, good governance and liberal economy to accelerate all round development of Nepal and Nepalese. This party aims at resolving human, technology and the environmental issues we face in 21st century.
Green Nepal Party is committed to multiparty democracy and accepts the values established by Janandolan Second-2063(2006 A.D) i.e. participatory, democracy, upliftment of Dalits, Marginalised groups, woman rights and progressive transformation of Nepal and Nepalese Society. Accordingly party accepts the democratic federal republic of Nepal and fully believes and abides the interim constitution of Nepal issued in 2063 B.S(2006 A.D) Magh 1st.
| 1. Name: |
1.1 Party's name is "Hariyali Nepal Party" and "Green Nepal Party" in English.
1.2 Green Nepal Party functions in accordance with this constitution and Party members must obey this constitution. Relationship with all fraternal wishers will be established in accordance with this constitution.
| 2. Objectives: |
The main objectives of this party is to secure "Freedom Peace, National Unity, Prosperity and Social Justice" as stated in the preamble of this constitution.
2.1 Establish transparent liberal democratic multiparty system with sovereignty vested in Nepalese
people and good governance.
2.2 Liberal Economic Policies.

2.5 Religious harmony.
2.6 Encouragements to backward caste and class.

Green Nepal Party's flag has three doves flying in
same direction on a green base. Flying doves represent
freedom and peace, all flying in the same direction
shows national unity and its green base denotes
prosperity.
| 4. Party's election symbol: |
The party's election symbol is mango with leaves
by the Election Commission.
| 5. Office: |
Party's headquarters will be located in Nepalese capital and branch offices will be opened all over the country as necessary.
| 6. Membership: |
Membership can be granted to qualified Nepalese citizen
as per party's constitution, who express their faith to this
constitution and wish to work in accordance with the
constitution, have paid their membership dues and have
attained sixteen years of age. There are four types of
membership.
| A) Devoted Member: |
Party can enroll Devoted Member to those Rs.
Two per month or Rs. Twenty-four yearly.
| B) Committed Member: |
Party can grant Contributing Member status to hardworking individual who commits to full time politics and pay membership dues of Rs Twenty-five per month or Rs. Three Hundred yearly.
| B) Contributing Member: |
Party can grant Contributing Member status those who help the party financially or in some other ways and pays membership dues of Rs One Hundred per month or Rs. Twelve Hundred yearly.
| D) Donor Member: |
Party can grant Donor Member status as mark of respect to those who donate at least Rs. One Thousand per month to the party.
| E) Secrecy of names: |
Secrecy of names will be maintained, if desired by the members, explained in sub-section "C" and "D". The party can grant membership status to these members any time they wish, provided they maintain continuity.
6.1 The duration of the membership status will be from one national conference to another conference for a period of four years Membership dues can be paid yearly, bi-yearly or as a lump sum.
6.2 Central Executive Committee can decide and ask members to donate not exceeding 5% of their income to help the party. Central Executive Committee or Constituency Unit can waive, as deemed appropriate, membership dues or other dues if members apply for waivers on grounds of incapacity.
6.3 Designated officials by Central Executive Committee or Constituency Unit or Committed Members can grant Devoted membership to all qualified when the membership) forms are received. All membership categories mentioned in sections (B), (C), (D) can be bestowed only after the decision of Central Executive
Committee / Constituency Unit.
6.4 Green Nepal Party members will uphold democratic values and norms as well as possesses good moral character.
6.5 Members will promote fraternity and help each other.
6.6 Members will continuously try to increase new membership and improve image of the party.
6.7 Constituency Unit will keep the record of all members of the constituency and Central Unit will keep the records of its members for the entire country.
6.8 Members of Green Nepal Party are forbidden to take membership of other Political parties or organizations.
| 7. End of Membership |
A) If resignation is tendered.
B) Acts against the interest of the party.
C) Involvement in acts that degrades members' moral
character.
D) Misuse of party's fund.
E) Enable to work for the party.
F) End of membership tenure.
G) Violation of party discipline.
7.1 The membership can be suspended during the
disciplinary process by Constituency Unit or Central
Committee. All positions, at different level, held by the
suspended member will be suspended too.
| 8. Constituency President: |
8.1 Constituency President must demonstrate high degree of idealism, show commitment to democratic values and norms to build the usage and to enlarge the party base. Fosters fraternal relationship between the party members, encourages cooperation between members and acts mutedly in a disciplined manner to promote party's cause.
8.2 Effectively manages the Constituency Unit through division of works among the Office bearers

8.3 Coordinates and manages unit's funds through the treasurer. Maintains the Accounts and gets it audited as per the direction of Central Executive Committee.
| 9. District Coordinate Council: |
9.1 District Coordinating Council will be formed in districts. The President of Constituency Unit where the district headquarters is located will work as the coordinator of the District Coordinating Council. The members of District Coordinating Council are the Presidents and Secretaries of all Constituencies within the region. The Constituency Unit will function as the District Coordinating Council if there is only one election constituency in one district.
9.2 The District Coordinating Council can nominate in the Council from women, intellectual, backward group, scheduled caste renowned persons, as deemed necessary.10. Work and duties of District Coordinating Council:

10.1 Acts as intermediary information distribution center between the Central Executive Committee and the Constituency Unit and coordinates district level party programmed.
10.2 Coordinates party's works, Channelizes information and works to strengthen the party.
10.3 Keeps the accounting records.
| 11. Formation of the National Assembly: |
11.1 One delegate from each election constituency will be elected to National Assembly by members of the constituency provided there is party's organization. It is necessary to be a committed member to represent to the National Assembly.
11.2 All participants attending the first convention of Green Nepal Party will be declared "Founder Members" and to those who have consented in writing to be the member of the party at that time. This first conference will formally establish Green Nepal Party by adopting the party's constitution, flag, policies and programmes of the party. All members attending the first Green Nepal Party Conference will automatically become the members of National Assembly till there will be a formally elected National Assembly.
11.3 High Command can authorize to send additional two delegates to National Assembly from the districts that have more than two Constituencies. High Command will decide the constituency from where additional members will be represented to National Assembly.
11.4 There will be delegates to the National Assembly from sister organizations and different class organizations. As instructed by High Command, Constituency Unit will submit the names from sister organizations and scheduled caste, for example. Women, Laborers, Students, Teachers, Lecturers, Journalists, Writers, Actors, Business Person, Lawyers, Industrialists, Intellectuals and other professionals to the National Assembly. Constituency Units propose the names of such individuals to High Command from Devoted Members, Committed members, Contributing Members and Donor Members to be represented to the National Assembly. High Command prescribes different groups and proposes to Constituency Units to submit two names from each group. High Command will nominate members, not exceeding forty, to the National Assembly from proposed names.
11.5 High Command can nominate delegates, as deemed necessary, to National Assembly if the delegates’ seats from Constituency Units are vacant.
| 12. Works and duties of National Assembly: |
12.1 National Assembly is the highest and most powerful body of Green Nepal Party. The resolutions passed by the National Assembly win be final and is binding to all units, officials and members.
12.2 The term of National Assembly is four Years. Reigning National Assembly will be in office till newly elected National Assembly is fanned. National Assembly may call for review sessions in every two years to assess the works of the party, national and international situations and provide suggestion to the Executive Committee as necessary.
12.3 National Assembly Conference will be held in every four years. High Command or Central Executive Committee can decide and call National Assembly conference whenever needed. Central Executive Committee is required to call National Assembly conference if 25% of the total National Assembly member requests to writing explahung the reason for such conference.
12.4 There should be an advance notice of 21 days. Ten days notice is enough to call extraordinary National Assembly conference. But public notice must be given in case of extraordinary conference.
12.5 The quorum for National Assembly conference is 50 % and they should be present in person. The National Assembly conference will be postponed for 24 hours if there is no quorum for the appointed time. After 24 hours the National Assembly conference will be held in the same place and members present at that national Assembly conference will make the quorum. Such conference is legal.
12.6 Majority's decision will prevail National Assembly conference.
12.7 National Assembly conference elects the members of High Command not exceeding of seven members. The term for High Command is four years. But the term for the elected High Command members from first National Assembly conference is eight years.
12.8 National Assembly conference will elect Central Executive Committee not exceeding 21 members. Representation in this Central Executive Committee will be based on number of election constituencies m each district. Six Central Executive Committee members will be elected from group of the districts that have one or two election constituencies, six Central Executive Committee members from the group
of districts that have four or more constituencies. The term for Central Executive Committee is four years.
12.9 Executive Committee members from the group of districts that have three election constituencies and nine Central Executive Committee members from the group of districts that have four or more constituencies. The term for Central Executive Committee is four years. High Command will nominate member to Central Executive Committee as necessary for the remaining term as mentioned in 12.8 if vacancy cannot be filled out from those constituencies for lack of organizational units.
12.10 High Command can nominate up to ten members to Central Executive Committee, who can significantly contribute to the party. The term of nominated members will end at the same time when the term of elected officials will expire.
12.11 National Assembly conference will approve the policies and programmes of the party submitted
by Central Executive Committee. The President will submit the activity report on behalf of Central Executive Committee at National Assembly conference to get it approved.
12.12 The treasurer on behalf of Central Executive Committee will submit Central Executive Committee's budget for coming years to National Assembly conference. The treasurer presents the accounts on yearly basis, from one conference to another conference to get it passed at National Assembly conference. The fiscal year for the party is July 16 - July 15.
12.13 National Assembly conference can amend the constitution of the party.
| 13. Works and duties of High Command: |
13.1 High Command will devote itself to strengths the party by devising the long term plans of the party. High Command acts as the "Think Tank" of the party. High Command guides and assits Central Executive Committee and other units of the party.
13.2 High Command reviews the work of the units and its officials. High Command hears the complaints or appeals of all members. It renders its decision on appeals or complaints after enough scrutiny.
13.3 High Command members are also the member of the Central Executive Committee. High Command performs all functions of Disciplinary proceedings of the party.
13.4 High Command acts as parliamentary committee to select the candidates for local and parliamentary elections.
13.5 High Command can delegate its authority to Central Executive Committee, units or any officials of the party to perform certain tasks. It can appoint representatives and observers, form committees, sub-committees, fact finding commission, investigation commission to perform its duties. High Command may deliver its decision on receipts of reports, complaints and information after proper inquiry and investigation.
13.6 High Command members are not allowed to contest national elections at local or parliamentary level.
| 14. Central Executive Committee: |
14.1 Under the guidance of High Command, Central Executive Committee functions and manages the
works of the party in accordance with the policies and programmes approved by National Assembly. The decision of High Command will prevail where there is difference of opinion between High Command and Central Executive Committee.
14.2 Provides guidance to District Coordinating Council and Constituency Unit to build the image of the party.
14.3 Provides training to party workers. Propagates and informs party's policies and programmes Arranges gatherings and conferences. Enforces the code of conduct of the party. Promotes and assists to uphold democratic ideals, values and norms.
14.4 Manages the central office. Appoints needed staff after proper division of work. Operates the funds of the party with the help of t the treasurer. Presents audited yearly statements of accounts at the meetings of High Command and National Assembly.

14.6 Collects funds like membership dues, donations and financial assistance to operate the party. Decides to waive membership fees if necessary, Assists party's units to keep proper statements of accounts and arranges the audits of their accounts.
14.7 Maintains good relationship with sister organizations, national and international organizations and political parties. Arranges to send delegates to participate in national and international conferences as necessary.
14.8 It can form committees, sub-committees, inquiry and investigation commission and define their
work area to get the task performed. Central Executive Committee will deliver its decision after proper investigation on received complaints and reports.
14.9 Central Executive Committee can decentralize its authority to other units or officials of the party to perform certain tasks.
14.10 The quorum for Central Executive Committee meetings is 50 % of the membership. Majority's decision will prevail.
14.11 Sends observers and representatives to different units and arranges to conduct elections at different levels.
| 15. Central President's work and duties: |
15.1 Central President will be elected by CentraI Executive Committee and High Command members. The term of the President is two years. The same person cannot be President for more than two terms.
15.2 The Central President can appoint party's General Secretary, Treasurer and all other office bearers as necessary amongst Central Executive Committee members and describe their work and duties. These officials will work as per the instruction of the President and stay in their post as long as the President desires.
15.3 The President manages the central office and establishes necessary departments to manage party office. The President will prepare its work plan and prescribe work procedures and gets it approved by Central Executive Committee. The President is responsible to make the party effective.
15.4 The Central President is responsible to execute the directives and the decision of High Command, Central Executive Committee and National Assembly.
15.5 The President will appoint the observer, representative, investigation commission and give his decision based on the report received from them.
15.6 The President is responsible to prepare and present reports in every two years or on a yearly basis to High Command, Central Executive Committee or National Assembly.
15.7 The President generally presides the meetings of the party. Other party members can also preside
as necessary.
| 16. Work and duties of party General Secretary and other Officials : |
16.1 The party General Secretary works in accordance party guidelines and the rights and duties vested to him/her by the party President As delegated party General Secretary works as secretary to National Assembly, High Command, Central Executive Committee also.
16.2 The party General Secretary is responsible to run the central office. The central office staff works
under the direction of the party General Secretary and follow the prescribed code of conduct.
16.3 Preparers, forms, and enforces party's decisions.
16.4 Keeps party's records, attests the documents, manifestoes and papers. Works as legal representative for the party as necessary.
16.5 Ensures smooth running of branch offices makes visits and instructs them as necessary.
| 17. Work and duties of the Treasurer: |
17.1 Treasurer functions in accordance with party's decision and President's direction.
17.2 Keeps the record of party's revenues and expenditures.
17.3 Treasurer will get the accounting records audited as directed by the party.
17.4 Under party's direction, handles cash and bank accounts of the party.
17.5 Presents party's financial programmes, budget and yearly accounts at Central Executive Committee meeting.
17.6 Presents audited reports of his/her term to Central Executive Committee. The treasurer will get party's annual accounts audited and gets it approved from the Central Executive Committee meeting and National Assembly conference.
17.7 The treasurer instructs local units and branch offices to keep proper records and get the accounts audited. Inspects branch offices from time to time.
17.8 Gets yearly accounts from all branch offices and prepares a consolidated statement of accounts
and gets it audited.
17.9 Remains vigilant against the misuse of party's fund and assets.
| 18. Parliamentary Party: |
18.1 Parliamentary party consists of all incumbent members of upper house and lower house, who have been elected from the ticket of Green Nepal Party. The name of this group is called "Parliamentary party of Green Nepal Party".
18.2 Parliamentary party will have a separate constitution. This Parliamentary party's constitution will be effective only after High Command approves it.
18.3 Members of both houses will be the member of National Assembly ex-officio.
| 19. Vote of No Confidence: |
Vote of no confidence motion against High Command, Central 'Executive Committee or Central Executive Committee member can be brought if one third National Assembly members request in writing explaining the reason for no confidence motion in accordance with party constitution. The accused will be given fifteen
days to defend the case. The National Assembly can impose penalty, if two third of its members present in the meeting, vote in favor of no confidence resolution. Similarly, all other units of the party can follow the same procedure to bring vote of no confidence against party units and its members. The accused can appeal against the decision of lower unit to a higher unit. The decision of higher unit will be final.
